These terms govern your use of www.the-isla.org and donations made through the website to the Initiative for Strategic Litigation in Africa (“ISLA”, “we”, “us” or “our”).

Please read these terms before using the website or making a donation.

You may use this website for lawful purposes consistent with these terms.

You must not attempt to gain unauthorised access, interfere with website operations, introduce malicious software, impersonate another person or submit unlawful, fraudulent or abusive material.

We may restrict access where reasonably necessary to protect the website, its users or our legal rights.

  1. Information and legal advice

Website content is provided for general information, education and advocacy.

It does not constitute advice tailored to your circumstances. Reading content, making a donation or submitting an enquiry does not create an attorney-client relationship or an agreement for legal representation.

Unless otherwise stated, website content is owned by ISLA or used with permission.

  1. Donations

Donations support ISLA’s work and organisational activities. Unless we expressly agree otherwise, donations are voluntary contributions and do not purchase goods, services, legal advice or representation.

Where a campaign specifies a particular purpose, we will administer contributions in accordance with that purpose and any campaign terms.

Please check the donation amount and your details before completing payment. The checkout will display the applicable currency; payments in South African rand will be identified as ZAR or R.

  1. Payment processing

Online payments are processed through PayFast and the providers involved in your selected payment method.

A donation is confirmed once successful payment has been verified. A failed, cancelled or pending transaction is not confirmation that ISLA has received the donation.

Your bank or payment provider may apply charges or currency conversion costs. Please check these with your provider.

Never send card security codes, banking passwords or other payment credentials to ISLA by email.

  1. Recurring donations

Where recurring donations are offered, the amount and frequency will be displayed before you authorise payment.

You may request cancellation of future recurring payments by contacting info@the-isla.org or using any cancellation facility provided by the payment service.

Please submit cancellation requests before the next scheduled payment. If a payment has already been processed, it will be handled under the refund provisions below.

  1. Donation refunds and payment errors

If you believe a donation was duplicated, unauthorised, made in error or processed for an incorrect amount, contact info@the-isla.org promptly.

Include your name, donation date, amount, transaction reference and the reason for your request. Do not send full card details or banking passwords.

We will review each request and may ask for information needed to verify the transaction. Refunds are subject to applicable law and the relevant payment provider’s procedures.

Where approved, a refund will ordinarily be returned through the original payment method where supported. Processing times depend on the payment provider and financial institutions involved.

A change of mind does not automatically create an entitlement to a donation refund. This does not limit any rights available under applicable law.

If you suspect an unauthorised transaction, also contact your bank or payment provider promptly.

  1. Donation acknowledgements and tax treatment

A payment confirmation or donation acknowledgement is not automatically a tax-deductible receipt.

Any eligibility for a tax deduction depends on applicable law, ISLA’s relevant approval status and the nature of the donation. Contact us to confirm whether an appropriate tax receipt can be issued.

Making a donation does not automatically subscribe you to marketing communications.

  1. Website availability and accuracy

We take reasonable steps to keep website information accurate and the website operational. Content may change, and interruptions or errors may occur.

If you identify an error, please notify us at info@the-isla.org.

  1. Liability

To the extent permitted by applicable law, ISLA is not liable for indirect or consequential losses arising from website use, interruptions or reliance on general website information.

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud or gross negligence, or limits rights that applicable law protects.

  1. Changes to these terms

We may update these terms and publish the revised version on this page.

The terms presented when you make a donation apply to that transaction. Changes will not retrospectively remove rights associated with a completed donation.

  1. Applicable law and disputes

These terms are governed by South African law, subject to any mandatory legal protections that apply.

Please contact info@the-isla.org first so that we can try to resolve a concern. If it cannot be resolved, either party may approach a court or other authority with appropriate jurisdiction.

About Us

Founded in 2014, the Initiative for Strategic Litigation in Africa (ISLA) is a Pan-African and feminist initiative with a timely remit: to strengthen strategic human rights litigation across the African continent. Essentially, we aim to change the way that strategic litigation is used so as to enable broader access to justice and to support those who seek to hold states accountable for violations of women’s human rights and sexual rights.
